    6. Resolution 2011-58 authorizing the City Council to execute a State Highway Right of Way Contract with the City of Fairfield and the State of California Department of Transportation for the disposition of an Easement Deed and granting of an Easement Deed to Pacific Gas and Electric to facilitate the Interstate-80 Eastbound Cordelia Truck Scale Relocation Project (Peri Dean, 428-7089).

    Funding Source: The Easement Deed has a value of $500 and the funds will be deposited into the General Fund.

    Recommended Action: Adopt resolution.

    NEW BUSINESS (Item 7)

    7. Resolution 2011-59 approving the plans and specifications and awarding a contract to Ghilotti Construction Company for the Viking Lane/Markeley Lane Bypass Project (Steven L. Hartwig, 428-7494).

    Funding Source: The construction authorization for this project will be $978,529, which is the bid amount, plus a 10% contingency. The construction will be funded by a combination of Gas Tax and AB 1600 funds. These funding sources will be reimbursed through the Northeast Area Fee Program once development activity resumes in the area.

    Recommended Action: Adopt resolution.

    8. Public hearing and introduction of Ordinance 2011-04 approving the Second Amendment to the Development Agreement between the City of Fairfield and Green Valley Land, LLC, a Delaware limited liability company extending the term of the agreement, modifying various recitals and sections, modifying Exhibit “B” Development Plan and modifying Exhibit “C” Description of Traffic Mitigation Measures of the agreement for Green Valley Corporate Park located east of Green Valley Road, west of Suisun Valley Road, north of Interstate 80, and south of Mangels Boulevard (APNs: 0045-280-370, 380, 390, 400, 410, 420, 490, 530, 540, 550, 560, 570, 580, 590, 660, 670, 680, 710, 720, 730, 740, 750 and 760) (Joseph A. Lucchio, 428-7647).

    Funding Source: There are no financial impacts associated with the proposed Second Amendment.

    Recommended Action: 1) Hold public hearing; 2) Waive first reading of ordinance in full and approve reading by title only; and 3) Approve first reading of ordinance.

    Resolution 2011-60 adopting General Plan amendment (G.P. 2010-1 and G.P. 2010-4) and Environmental Reviews (E.R. 2010-1 and E.R. 2010-26) and rescinding Resolution 2010-255 that approved General Plan amendment (G.P. 2009-1) and Mitigated Negative Declaration (E.R. 2009-14) affecting properties located in Fairfield; and


    Introduction of Ordinance 2011-05 amending Chapter 25, Article I of the Fairfield City Code to rezone approximately 19.57 acres located on the south side of Red Top Road, west of the future Havenhill Road (APN: 0180-070-080 portion) from the CC (Community Commercial) and CR (Regional Commercial) Zone to the RH (High Density Residential) Zone; and

    Introduction of Ordinance 2011-06 approving the Third Amendment to the Development Agreement between the City of Fairfield, the Fairfield Redevelopment Agency and Albert D. Seeno Construction Company, Inc., a limited partnership, Seecon Financial Construction Co., Inc. and West Coast Home Builders, Inc., all California corporations, guaranteeing development of the Villas at Havenhill Project on approximately 19.57 acres of land located on the south side of Red Top Road, west of the future Havenhill Road (APN: 0180-070-080 portion); and

    Introduction of Ordinance 2011-07 amending Chapter 25, Article I, Section 25.12.3 of the Fairfield City Code, also known as the City of Fairfield Zoning Map, rezoning approximately 433 acres located north of Air Base Parkway, east of Clay Bank Road, south of the Putah South Canal (APNs: 0166-110-150, -360, -420, -430, -450; 0166-120-150, -870, -880, -890; 0167-190-340, -370; 0170-010-020, -400, -410; 0170-050-060, -230, -250, -260, -280, -290 – or portions thereof; and

    Introduction of Ordinance 2011-08 repealing Ordinance 2010-08 amending Chapter 25, Article I of the Fairfield City Code (Richard W. Hancock, 428-7450).

    Funding Source: There is no direct financial impact; developers will pay all fees.

    Recommended Action: 1) Hold public hearing; 2) Adopt resolution; 3) Waive first reading of ordinances in full and approve reading by titles only; and 4) Approve first reading of ordinances.

    10. City Council discussion of process for selecting solid waste collector for the City of Fairfield and consideration of Resolution 2011-61 approving an amendment to the Consultant Services Agreement between the City of Fairfield and R3 Consulting Group, Inc. to assist the City in negotiations with the City’s existing solid waste collector and rescinding Resolution 2011-19B (David White, 428-7398).

    Funding Source: The total cost of the amendment to R3’s Consultant Services Agreement that was adopted by the City Council is not-to-exceed $90,000. The total cost of the attached resolution is $30,000. The Solid Waste Reserve Account is the funding source. The City will seek reimbursement for all consultant fees and City Attorney fees from the solid waste firm that wins the final solid waste contract as part of its negotiations.
