Presentation of Exceptional Performance Citations to Police Department employees: Officer Sam Rowland, Officer Justin Gutierrez, Officer Erik Aagaard, Dispatch Shift Supervisor Peggy Mobley and Dispatcher Alisha Swaim (Larry Todd, 428-7366). 2. Recognition of MV Transportation Driver Gary Mooring and Dispatcher Pricilla Zepeda (George Fink, 428-7768). COUNCIL CONSENT CALENDAR (Items 3-11) Video Audio Only CONSENT CALENDAR NOTICE All matters listed on the Consent Calendar are to be approved with one motion unless a member of the Council or the public requests that separate action be taken on a specific item. 3. Approval of minutes: (a) June 15, 2010 – regular meeting; (b) June 15, 2010 – special meeting; and (c) June 22, 2010 – special meeting. Recommended Action: Approve minutes. 4. Minute action approving Mayor’s appointments to the Planning Commission and Housing Authority (Claudia Archer, 429-6296). Funding Source: There are no costs associated with these appointments. Recommended Action: Approve appointments to the Planning Commission and Housing Authority by minute action. 5. Resolution 2010-179 and Redevelopment Agency Resolution RA2010-12 approving the First Amendment to the Operating Agreement by and between the City of Fairfield, Fairfield Redevelopment Agency and Solano County eliminating provisions for shared security costs within the County Government Center Project in Downtown Fairfield (Curt Johnston, 428-7445). Funding Source: Maintenance and security for the project cost the City approximately $142,705 annually. Approval of the First Amendment to the Operating Agreement would reduce the City’s General Fund cost by $107,912 annually until 2015 when the agreement is due to expire. The City will continue to pay the County $34,799 to offset maintenance costs of the project. Recommended Action: Adopt resolutions. 6. Redevelopment Agency Resolution RA2010-13 approving the Amended and Restated Participation Agreement by and between the Agency and Mercy Properties California (Lark Ferrell, 428-7457). Funding Source: The proposed Amended and Restated Participation Agreement increases the Agency’s Low and Moderate Income Housing Fund’s loan to the project by $232,000. This expenditure is budgeted in the Agency’s Low and Moderate Income Housing Fund’s budget. Recommended Action: Adopt resolution. 7. Resolution 2010-180 authorizing the Public Works Director to negotiate and execute on behalf of the City of Fairfield a Purchase Order with BusWest for three paratransit buses (George R. Hicks, 428-7494). Funding Source: The cost to purchase three paratransit buses is estimated at $225,000 using Transportation Development Act (TDA) funds, Proposition 1B, and Public Transportation Modernization, Improvement and Service Enhancement Account (PTMISEA) funds. All operating and capital expenses for Fairfield and Suisun Transit are supported using specific state and federal transportation funding sources. No General Fund monies are used. Recommended Action: Adopt resolution. 8. Resolution 2010-181 approving Amendment No. 2 to the Agreement for Consulting Services for the Water and Sewer Main Replacement Project with Creegan + D’Angelo (George R. Hicks, 428-7494). Funding Source: The added design work will be completed on a time-and-materials basis with a maximum authorized additional fee not to exceed $39,000, for a new engineering upper limit of $232,000. Staff has reviewed the proposal and found the fee basis and estimate to be reasonable given the scope of work. The project is budgeted and funded by the Water Improvements Fund. No General Fund monies will be used for this project. Recommended Action: Adopt resolution. 9. Resolution 2010-182 authorizing the Mayor to execute a Consent Agreement for Joint Occupancy of Right-of-Way owned by the Solano Irrigation District (George R. Hicks, 428-7494). Funding Source: There will be no direct fiscal impact to the City. Recommended Action: Adopt resolution. 10. Resolution 2010-183 approving the Employer Support of the Guard and Reserve (ESGR) (Barbara Dillon, 429-6299). Funding Source: There is no financial impact to the City. Recommended Action: Adopt resolution. 11. Resolution 2010-184 authorizing the City Manager to execute a Professional Services/Retired Annuitant Agreement (Erin L. Beavers, 428-7649). Funding Source: There is no financial impact to the City. All costs associated with the agreement will be paid by Canon Station, LLC, the major landowner within the specific plan area. Recommended Action: Adopt resolution. Item 12 Video Audio Only 12. Council discussion and minute action to select a voting delegate and alternate voting delegate(s) for the 2010 League of California Cities Annual Conference (Claudia Archer, 429-6296). Funding Source: The fee for Councilmembers to attend the entire conference is $475 per person or $250 for the one day meeting. These registration costs will be paid from the General Fund. Recommended Action: Hold discussion and select a voting delegate and alternate voting delegate(s) by minute action. Item 13 Video Audio Only 13. Resolution 2010-185 initiating amendments to the General Plan and Zoning Ordinance to promote the importance of the NorthBay Medical Center Hospital at its current location (Erin Beavers, 428-7649). Funding Source: No direct financial impact, other than the California Environmental Quality Act (CEQA) filing fee of $2,060 for the fish and wildlife impact fee and posting fee, should the amendments be approved, which would be paid from the General Fund. Recommended Action: Adopt resolution. Item 14 Video Audio Only 14. Resolution 2010-186 approving the purchase of a public safety application suite and related services from Sunridge Systems, Incorporated (Dawn Shepherd, 428-7707; Steve Garrison, 428-7582; and Greg Hurlbut, 428-7606). Funding Source: The purchase price shall not exceed $1,100,000 and includes equipment, sales tax, installation, training and 12 months maintenance. The funding will come from the Technology Internal Service Fund. The annual maintenance of the system costs $92,000 and will be paid from the Technology Internal Service Fund. The annual maintenance cost is $73,000 less than what the City currently pays for system maintenance per year. Recommended Action: Adopt resolution. Item 16 Video Audio Only PUBLIC HEARINGS (Item 16-23) 16. Public hearing and Resolution 2010-188 approving formation of the Paradise Valley Maintenance and Monitoring District as a Geologic Hazard Abatement District (GHAD) within the meaning of Division 17 of the Public Resources Code and appointing the City Council of the City of Fairfield as the GHAD Board of Directors (George R. Hicks, 428-7494). Funding Source: None. The costs for the formation of the GHAD have been paid for and/or reimbursed by Arcadia Development Company. The costs for the operation of the GHAD pursuant to the Paradise Valley Plan of Control will be funded from the levy of assessments from within the limits of the District. In addition, as a subdivision of the State and not the City, the City does not incur any potential liability associated with GHAD activities or responsibilities. Recommended Action: Hold public hearing and adopt resolution. Item 17-21 Video Audio Only 17. Public hearing and Resolutions 2010-189 through 2010-201 approving the 2010-2011 Engineers Reports, confirming the boundaries and ordering levy and collection of assessments and providing for Notice of Hearings thereof for Maintenance District No. 1 – Gateway; No. 3 – Waterman Highlands; No. 4 – Suisun Valley Road-Kaiser; No. 6 – Peppertree; No. 7 – Rolling Hills; No. 8 – Kolob Estates; No. 10 – Southbrook; No. 11 – Paradise Valley North; No. 14 – Woodlake; No. 15 – Gold Ridge; No. 16 – Creekside at Cordelia; No. 17 – Chadbourne-Beck-Cordelia; and No. 18 – Gold Ridge Park (George R. Hicks, 428-7494). Funding Source: The City will contribute a total of $69,570 to these Districts. This contribution is for street lighting and arterial landscaping and irrigation. These credits are in accordance with Resolution 91-213B and appear in the General Fund contribution line of each District budget. The total assessments for all the above Districts are proposed to be approximately $1,892,608. Recommended Action: Hold public hearing and adopt resolutions. 18. Public hearing and Resolution 2010-202 approving the 2010-2011 Supplement to Engineer’s Report, confirming the boundaries and assessment and ordering levy of assessments (Smith Ranch Assessment District) (George R. Hicks, 428-7494). Funding Source: These assessments will generate approximately $273,375 in funding for the maintenance of private streets and street storm drains within the Rancho Solano subdivision. Recommended Action: Hold public hearing and adopt resolution. 19. Public hearing and Resolution 2010-203 approving the 2010-2011 Engineer’s Report, confirming the boundaries and ordering levy and collection of assessments and providing for Notice of Hearings thereof for Maintenance District No. 5 – Smith Ranch (Rancho Solano) (George R. Hicks, 428-7494). Funding Source: In addition to the $300,000 in assessments collected from the property owners within the District, the City General Fund will contribute approximately $122,000 to this District. This contribution is made to cover the cost of those street landscaping and street lighting improvements along Mankas Blvd. and Rancho Solano Parkway, which have been determined to be of general benefit to City residents rather than special benefit to the residents of Rancho Solano. These City contributions are made in accordance with Resolution 91-213B and appear in the General Fund contribution line for the District. Recommended Action: Hold public hearing and adopt resolution. 20. Public hearing and Resolution 2010-204 approving the 2010-2011 Engineer’s Report, confirming the boundaries and ordering levy and collection of assessments and providing for Notice of Hearings thereof for Maintenance District No. 12 – Downtown Business District (George R. Hicks, 428-7494). Funding Source: There are no General Fund contributions to this District. The total assessment for the District during next fiscal year will be approximately $62,256. Recommended action: Hold public hearing and adopt resolution. 21. Public hearing and Resolution 2010-205 approving the 2010-2011 Engineer’s Report, confirming the boundaries and ordering levy and collection of assessments and providing for Notice of Hearings thereof for Maintenance District No. 13 – North Cordelia (George R. Hicks, 428-7494). Funding Source: The City General Fund will contribute approximately $23,000 to this District. This contribution is for street lighting, arterial landscaping and irrigation. These credits are in accordance with Resolution 91-213B and appear in the General Fund contribution line of each District budget. The total amount of the proposed assessments for this District is $428,551. Recommended Action: Hold public hearing and adopt resolution. Item 22 Video Audio Only 22. Public hearing and Resolution 2010-206 declaring a public nuisance and authorizing abatement of dry weeds and rubbish on 4 undeveloped parcels (APNs: 0034-122-100, 0034-201-180, 0038-221-010 and 0037-153-210) (Jerry E. Clark, 428-7341). Funding Source: If unable to recover directly from property owners, the cost of abatement, including administrative costs, are typically recovered through property liens. Recommended Action: Hold public hearing and adopt resolution. 23. Continue to July 20, 2010: Resolution 2010-173 declaring the results of the Property Owner Protest Ballot Proceeding for Landscaping and Lighting District No. 19 (Corporate Commons) and approving certain related actions; and Resolution 2010-174 amending and/or approving the final Engineer’s Report regarding the formation of Landscaping and Lighting District No. 19 (Corporate Commons); and the levy and collection of annual assessments related thereto commencing in Fiscal Year 2010/11; and Resolution 2010-175 confirming the formation of Landscaping and Lighting District No. 19 (Corporate Commons); Assessment Diagram and ordering the levy and collection of assessments for Fiscal Year 2010/11 (George R. Hicks, 428-7494). Funding Source: Establishment of Landscape and Lighting Maintenance District No. 19 will allow the City to collect special assessments that will be sufficient to provide for the maintenance of landscaping and lighting within the new District boundaries, which includes the existing Fairfield Corporate Commons area. The assessments to be collected in the first year total $181,318. No General Fund monies are being used in this District. If the District is not approved, the City will need to identify ways to reduce costs in the existing District budget. Recommended Action: Continue consideration of these three resolutions to July 20, 2010 at 6:00PM. ADJOURN TO TUESDAY, JULY 20, 2010, 6:00PM, COUNCIL CHAMBER.
