    2. Resolution 2011-160 authorizing the City of Fairfield’s application to the Federal Transit Administration for the State of Good Repair (SGR) bus grant funding to replace six buses (Steven L. Hartwig, 428-7494).

    Funding Source: There is no impact to the General Fund. Fairfield and Suisun Transit (FAST) operations are funded with federal, state, regional and local transit monies that cannot be used for other purposes. If this grant request is successful, the 20% non-federal match will come from transit reserves.

    Recommended Action: Adopt resolution.

    3. Resolution 2011-161 approving the plans and specifications and awarding a contract to Legg, Inc., for the Water and Sewer Main Replacement Program: Woolner Avenue (Steven L. Hartwig, 428-7494).

    Funding Source: The construction authorization for this project will be $569,186.16, which is the bid amount, plus a 10% contingency. This project will be paid for using Water Capital funds.

    Recommended Action: Adopt resolution.

    4. Resolution 2011-162 approving the Final Map and execution of the Subdivision Improvement Agreement for Garibaldi Ranch, Unit 3; and

    Resolution 2011-163 authorizing execution of the Landscape Improvement Agreement for Garibaldi Ranch, Unit 3 (Steven L. Hartwig, 428-7494).

    Funding Source: Acceptance of the public improvements will obligate the City to maintain the improvements. The public improvements include all project streets, sidewalks, streetlights, sewer, water and storm drainage. Annual maintenance costs for the subdivision’s public improvements to serve 86 homes and their funding sources are as follows:

    a) Streets $25,200 General Fund/Gas Tax
    b) Sewer $ 2,150 General Fund from
    Sewer Service fees
    c) Sidewalks $ 672 General Fund
    d) Streetlights $ 1,595 General Fund
    e) Storm drains $ 672 Storm Drainage
    Maintenance Fees

    Total Expenses: $30,289

    The City’s portion of the property tax collected through the county will amount to approximately $36,120 assuming an assessed per home value of $300,000. Landscape improvements along Lopes Road, Gold Hill Road and the entrance to this subdivision will be maintained by an existing landscape and lighting district. The special assessments will cover the cost of maintaining these areas. All other interior landscaping is maintained by the various fronting property owners.

    Recommended Action: Adopt resolutions.

    5. Resolution 2011-164 authorizing the City of Fairfield’s application to the Federal Transit Administration for Bus Livability Program grant funding and to the Metropolitan Transportation Commission for Regional Measure 2 Safe Routes to Transit Program funding to finance right-of-way acquisition for and construction of the West Texas Gateway Project (Steven L. Hartwig, 428-7494).

    Funding Source: No impact to the General Fund, unless the City Council wants to add scope that cannot be funded by grants from other agencies. If additional non-federal funding is required for matching, the local match will come from AB1600 or other capital funds. Maintenance of improvements can be funded with locally controlled Gas Tax revenues.

    Recommended Action: Adopt resolution.

    6. Resolution 2011-165 accepting an irrevocable offer of dedication of right-of-way on Peabody Road (Steven L. Hartwig, 428-7494).

    Funding Source: None.

    Recommended Action: Adopt resolution.

    7. Resolution 2011-166 authorizing the City Manager to execute an Agreement for Consulting Services between the City of Fairfield and JDH Corrosion Consultants, Inc. for connecting, testing, evaluating, reporting and monitoring cathodic protection systems as part of the Rancho Solano Subdivision Water Lateral Anode Installation Project (Steven L. Hartwig, 428-7494).

    Funding Source: The resolution will authorize the City Manager to execute a contract in an amount not-to-exceed $51,458. The total contract price includes $46,780 for JDH to complete the project and a $4,678 contingency. This project will be funded by Water Capital funds.

    Recommended Action: Adopt resolution.

    8. Resolution 2011-167 authorizing the City Manager to execute Amendment No. 1 to the Agreement for Consulting Services between the City of Fairfield and HNTB Corporation (HNTB) for the preliminary studies, design, bid assistance and construction administration for the Fairfield/Vacaville Train Station Project (Steven L. Hartwig, 428-7494).

    Funding Source: The proposed amendment and contingency in the amount of $457,822.20 increases the total not-to-exceed agreement amount authorized by the City Council to $4,416,254.20 ($3,958,432 original authorization + $416,202 Amendment No. 1 + $41,620.20 contingency to Amendment No. 1). The additional costs will be funded from various local, regional, state and federal funding previously allocated for the design and construction of the train station. No General Funds will be used. Recommended Action:  Adopt resolution.

    9. Resolution 2011-168 authorizing the City Manager to execute a Funding Agreement between the Solano Transportation Authority, County of Solano and City of Fairfield for the design and construction of the Jepson Parkway Project (Steven L. Hartwig, 428-7494).

    Funding Source: The City’s financial responsibility under this agreement is estimated at approximately $17.2 million. The City’s contribution will come in the form of in-kind contributions from staff assigned to complete the project, land dedications and environmental mitigation required for the project, and improvements to be completed by the adjacent developer at a future date. The agreement does not provide for repayment of a $2.9 million loan from the Solano Transportation Authority over five years beginning in August 2015. This loan will be repaid from AB1600 Street Capital funds.

    Recommended Action: Adopt resolution.

    10. Ordinance 2011-13 to comply with Part 1.9 of Division 24 of the California Health and Safety Code and taking certain actions in connection therewith (David White, 428-7398).

    Funding Source: The ordinance, if adopted, will commit the City to paying approximately $11.3 million in Fiscal Year 11/12 and $2.6 million, subject to annual adjustment, every year thereafter to the County Auditor-Controller in order to maintain redevelopment.

    Recommended Action: 1) Waive further reading of ordinance in full and approve reading by title only; and approve first reading of ordinance; and 2) Direct staff to prepare and present at a future City Council meeting the impacts of AB 26 and 27; and 3) Delegate to the City Manager and City Attorney the authority to file an appeal, if warranted, of the Department of Finance’s determination of the amount of the City’s required payment under AB 27 to maintain redevelopment.

    11. Public hearing and:

    a) Resolution 2011-158 certifying a Final Environmental Impact Report (E.R. 2010-19) for the Train Station Specific Plan, and adopting findings, a Statement of Overriding Considerations and Mitigation Monitoring Program related to the Final Environmental Impact Report; and

    b) Resolution 2011-159 adopting General Plan Amendment (G.P. 2010-2), adopting the Train Station Specific Plan, adopting amendments to various elements of the General Plan, repealing the Peabody Walters Master Plan, and redesignating approximately 2,972 acres of land generally located north of Cement Hill Road and Markeley Road, between the former Sacramento Northern Railroad right-of-way and North Gate Road; and


    c) Introduction of Ordinance 2011-11 amending Chapter 25, Article I of the Fairfield City Code to amend the North Gate Planned Development Overlay Zone, add the Train Station Planned Development Overlay Zone, and rezone to various designations approximately 1,400 acres of land generally located north of Cement Hill Road and Markeley Road, between the former Sacramento Northern Railroad right-of-way and North Gate Road; and

    d) Introduction of Ordinance 2011-12 approving a Development Agreement between the City of Fairfield, a municipal corporation and Canon Station, LLC, a California limited liability company, and Andrews Lando Associates, a California limited liability company (Ron Rowland, 428-7517).

    Funding Source: Infrastructure and public facility costs (see attached Financing Plan) of approximately $370 million, to be funded by a combination of: 1) Various development impact fees, including a revised Northeast fee, revised citywide AB 1600 fees, Bedroom Tax, Construction License Tax, County Facility fee; 2) Regional, state and federal roadway improvement funds through the Solano Transportation Authority; and 3) By developer obligations through a Development Agreement.

    Fiscal impacts to the General Fund (see attached Fiscal Impact Analysis) of up to $11.2 million to be funded by a combination of: 1) Various taxes, including property, transfer, utility user, franchise, sales and use taxes; 2) Annexation of land into existing and new community facilities districts; 3) Annexation of land into existing or new landscape and lighting maintenance districts; and 4) Annexation of residential properties would be annexed into existing or new homeowners’ associations.

    Recommended Action: 1) Hold public hearing; 2) Adopt resolutions; 3) Waive first reading of ordinances in full and approve reading by titles only; and 4) Approve first reading of ordinances.
